Program name: Nutcase Messaging.
Nutcase Messaging is the SMS text messaging program operated through Nutcase, case management software for law firms provided by Nutcase App LLC. It carries two kinds of messages:
- Firm-to-client messages. Conversational and informational text messages between a law firm and its own clients about the client’s matter: scheduling, appointment and deadline reminders, requests for documents or information, and case updates, plus the client’s replies.
- Account messages from Nutcase. Texts from Nutcase to people who work at a firm that uses the service, such as a one-time code to verify a login or a notice about their account.
Nutcase Messaging does not carry marketing or promotional messages, and it is never used to contact anyone who has not opted in.
Current status
The Nutcase service is in development. These terms were published before the first message was sent so that they are in place from day one, and they apply to every message sent through Nutcase Messaging once it is live.
Who sends messages, and why
If you are a client of a law firm that uses Nutcase, texts come from your firm, about your own matter. The firm is the sender; Nutcase provides the software the firm uses to send and receive them, and every message is filed to your matter in the firm’s records.
If you work at a firm that uses Nutcase, Nutcase itself may text you a one-time login code and, occasionally, a notice about your account.
How you opt in
You will receive texts only if you agreed to them.
Clients opt in with their firm, in one of three ways: by providing a mobile number and checking a box that is unchecked by default on the firm’s intake form; by texting a keyword the firm gives you to the firm’s number; or by turning on texting in the firm’s client app. Agreeing to texts is optional and is never a condition of hiring the firm or receiving its services. The first text you receive confirms your enrollment and repeats the STOP instruction.
The wording firms present next to the unchecked box reads substantially as follows:

Firm users agree to login-code texts when they add a mobile number to their account. Login codes are also always available by email, so no one is required to use text messages to sign in.
In every case, Nutcase records the date, the time, and the exact wording each person agreed to, and keeps that record for as long as needed to demonstrate consent.

Hi Sarah, this is Whitaker & Hale Law. Your deposition is confirmed for Tue Sep 22 at 10:00 AM. Reply STOP to opt out, HELP for help.
Account message from Nutcase:
Your Nutcase login code is 482913. It expires in 10 minutes. Reply STOP to stop receiving login codes by text, HELP for help.
Message frequency
Message frequency varies. Firm-to-client messages depend on the activity in your matter. Account messages from Nutcase are sent only when you sign in or when there is a notice about your account.
Fees
Message and data rates may apply. Nutcase does not charge you to receive messages, but your mobile carrier may charge for messages and data according to your plan. Check with your carrier for details.
How to stop
Reply STOP to any message to stop receiving texts from that sender. You will receive one final message confirming that you have been unsubscribed, and nothing further. UNSUBSCRIBE, END, QUIT, and CANCEL work the same way. Opting out of texts from your firm does not affect your relationship with the firm; it can still reach you by phone or email.

Carriers
Carriers are not liable for delayed or undelivered messages. Messages are delivered as standard SMS over carrier networks, which are not encrypted in transit. Nutcase Messaging is available on major U.S. carriers; availability on a specific carrier is not guaranteed.
Privacy
We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. Mobile information may be shared only with service providers that assist in delivering our services, meaning the messaging carrier and Twilio.
